For pickup orders, you are responsible for collecting your order at the designated location within a reasonable time. Orders not picked up within a reasonable time may be discarded, and no refund will be issued.

• Use our Services for any illegal, harmful, fraudulent, or deceptive purpose

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the design, selection, and arrangement thereof, are owned by Freshslice Pizza, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for your personal, non-commercial use. This license does not include:

• The right to reproduce, distribute, display, sell, lease, transmit, create derivative works, or otherwise exploit our content
• Any resale or commercial use of our Services or content
• Any collection and use of product listings, descriptions, or prices
• Any derivative use of our Services or content
• Any use of data mining, robots, or similar data gathering and extraction tools

6.3 Trademarks

The Freshslice Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Freshslice Pizza or its affiliates or licensors. You may not use these marks without our prior written permission.

6.4 User Feedback

If you provide us with any feedback, suggestions, ideas, or proposals regarding our Services ("Feedback"), you grant us an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free license to use such Feedback in any way and for any purpose without compensation to you.

7. Disclaimers and Limitations of Liability

7.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FRESHSLICE PIZZA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

INFORMATION REGARDING FOOD PRODUCTS, INCLUDING NUTRITIONAL INFORMATION AND ALLERGEN INFORMATION, IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY. WE DO NOT GUARANTEE THAT THIS INFORMATION IS ACCURATE, COMPLETE, OR UP-TO-DATE.

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FRESHSLICE PIZZA, ITS AFFILIATES, FRANCHISEES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
• ANY CONTENT OBTAINED FROM THE SERVICES
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT PAID BY YOU TO FRESHSLICE PIZZA FOR YOUR MOST RECENT ORDER, OR IF YOU HAVE NOT PLACED AN ORDER, ONE HUNDRED DOLLARS ($100).

7.3 Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit our liabilities, the scope and duration of such warranty and the extent of our liability shall be the minimum permitted under such applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Freshslice Pizza, its affiliates, franchisees, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from:

• Your violation of these Terms
• Your violation of any rights of any other person or entity
• Your use or misuse of the Services

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

9. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

You may terminate these Terms at any time by closing your account (if you have one) and discontinuing use of the Services.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The most current version of these Terms will be posted on our website with the "Last Updated" date at the top. If a revision, in our sole discretion, is material, we will notify you through the Services or via the email associated with your account (if applicable).

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Services.

11. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

Any legal action or proceeding relating to your access to, or use of, the Services or these Terms shall be instituted in the courts of the Province of British Columbia. You and Freshslice Pizza agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
